Terms of Service

Effective 2025

These Terms govern your use of Food Shuttle KY (the “Service”), a product of Lodyn Labs LLC (“we,” “us,” or “our”). By using the Service, you agree to these Terms.

1) Eligibility & Accounts

  • You must be at least 18 years old (or the age of majority in your state) to place orders.
  • Provide accurate information and keep your contact details up to date.
  • You’re responsible for all activity on your account and for maintaining the confidentiality of your credentials.

2) Service Overview

Food Shuttle KY is a logistics and pre-ordering service. Customers place and pay for orders through the Service, and we then transmit those orders to a restaurant and/or arrange delivery to the designated pickup location or, if available, to your address. We may modify, suspend, or discontinue features, routes, or delivery options at any time.

Important: Food Shuttle KY is not a restaurant. We do not cook food. We may purchase meals from restaurants and deliver them to you, but some restaurants are not our affiliates or partners and may not be aware that we are placing orders on behalf of customers.

3) Orders, Pricing & Payment

  • Prices, taxes, fees, and promotions are shown at checkout before you pay.
  • Payment is processed by a third-party provider (e.g., Stripe). By paying, you authorize charges to your card.
  • Some orders may be authorized at checkout and captured later (for example, after capacity checks).
  • Availability & Substitutions: If a restaurant is unable to fulfill an item, we may contact you for approval of a substitution or issue a refund for that item.

4) Cancellations & Refunds

Cancellations and refunds follow our Refunds Policy. In brief, full refunds are available if you cancel within the stated window. After that, cancellations aren’t allowed and no partial refunds are offered.

5) Temperature & Freshness

Meals are transported from restaurants to the pickup spot and, if selected, to your address. As a result, food may not be as hot or crisp as dine-in service. This is expected with transported food and does not qualify for a refund unless the order is undelivered or incorrect.

6) Allergens & Dietary Needs

Food Shuttle KY does not prepare food. Restaurants are solely responsible for cooking the meals. Because we have no control over restaurant kitchens, we cannot guarantee that meals are free from allergens or that cross-contact will not occur.

  • Your responsibility: If you have allergies, intolerances, or dietary restrictions, review allergen and ingredient information directly from the restaurant before ordering.
  • No custom preparation: We cannot alter recipes or request special allergen-safe handling beyond what a restaurant normally provides.
  • Labeling claims: Any “vegan,” “gluten-free,” “halal,” “kosher,” or similar claims come directly from the restaurant; we do not verify them.
  • Risk acknowledgment: By ordering, you accept the risk that meals may contain or come into contact with allergens including peanuts, tree nuts, dairy, eggs, wheat, soy, fish, or shellfish.

If you are uncertain about allergens or preparation, please do not place an order.

7) Pickup, Delivery & Risk of Loss

  • Pickup windows and locations are shown on route pages and in your confirmation. Bring your confirmation code.
  • If you select last-mile delivery, it occurs after distribution at the pickup spot.
  • Missed pickup: If you miss your pickup window, we cannot hold or re-deliver your food; no refunds apply.
  • Risk of loss passes at pickup or, for last-mile, upon delivery to the address you provided.

8) Acceptable Use

  • Do not misuse the Service (e.g., interfere with operations, attempt to scrape or reverse engineer, or break laws).
  • Do not submit content that is unlawful, infringing, or harmful.

9) Third-Party Services

The Service relies on independent restaurants and third-party providers (e.g., payment processors, mapping). We are not responsible for their acts or omissions. Your use of third-party services may be subject to their own terms and conditions.

10) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, LODYN LABS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LODYN LABS LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER AT ISSUE.

12) Indemnification

You agree to defend, indemnify, and hold harmless Lodyn Labs LLC from claims arising out of your misuse of the Service, violation of these Terms, or infringement of third-party rights.

13) Governing Law & Venue

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Fayette County, Kentucky.

14) Changes to the Service or Terms

We may update the Service and these Terms from time to time. Material changes will be posted here with an updated “Effective” date. Continued use after changes means you accept the revised Terms.
